Property Ownership
The land-plots in this development will be either sold (Freehold) by the registered Thai owner to a Thai Person/Entity, or otherwise leased (Leasehold) to a non-Thai Person/Entity for a period for 30 years. The period of thirty (30) years is the maximum lawful period for Leasehold Properties in Thailand. After the expiry of 30 years, a new lease for another 30 years must be officially registered. During the initial 30 year Lease, the following condition will be included:
In the event of a change in the Thai law pertaining to Foreign Land-ownership, the legal owner will offer the Freehold ownership rights to the Lessee in exchange for a symbolic amount plus the relevant fees/charges associated with the proper transfer-registration process.
The costs associated with an extension of Lease after the initial 30 year period with another 30 year period shall be a symbolic amount in addition to the relevant registration fees.
All Leasehold Agreements shall be duly and officially registered with the Royal Thai Land Department and fully in accordance with Thai law in order to afford maximum protection for the Lessee.
Ownership of Real Estate
With regards to the ownership of real estate, such as homes, building, improvements etc., there are no legal obstacles which stand in the way in relation to foreign ownership of such real-estate.
